"영주권 신청 수수료 대폭인상"

미국 영주권 (Permanent Residence; Greed Card)를 취득하기 위해 필요한 서류들이 다양하지만, NIW를 포함한 외국인 근로자를 위한 이민 청원서인 I-140 같은 경우는 수수료가 기존 $700에서 $715로 "$15"가 오른다.

문제는 두 번째 서류인 I-485 영주권 등록 또는 신분 조정 신청서 (Application to Register Permanent Residence or Adjust Status)이다.

지금까지는 I-485를 제출하면 워킹퍼밋(I -765)과 여행허가서 (I-131)을 같이 묶어서 처리해 주었고 인당 $1,225의 수수료가 들었다. 하지만 수수료를 인상하면서 I-485만 단독으로 신청하면 성인기준 기존 $1,225에서 $1,540로 인상하며, I-485와 함께 I-765와 I-131을 신청하면 기존 $1,225에서 $2,820으로 약 2.3배 인상된다.

또한, 할인이 적용되던 14세 이하 접수자에 대한 수수료가 기존 $750에서 $1,540로 수수료 할인이 적용되지 않는다. I-140 같은 경우는 주 신청자만 수수료를 내면 되지만 I-485 같은 경우는 가족 인원수 대로 서류를 접수해야 하기에 수수료가 정말 말 그대로 대폭인상이 되어버릴 것이다. 특히, 미국 내에서 NIW를 신청하는 분들은 보통 I-485, I-765, I-131을 패키지로 신청하기 때문에 더욱더 수수료 부담이 가중될 것이 예상된다.

1. USCIS Proposed Fee Increases

U.S. Citizenship and Immigration Services (USCIS) announced a proposed rule on January 3, 2023 that would increase many USCIS application filing fees. Some of the fee changes are significant, including the following (and others, including citizenship and naturalization filing fees):

Additionally, USCIS is proposing a new Asylum Program Fee of $600 to be paid by employers who file either a Form I-129 or Form I-140. DHS proposes this new fee as a way to mitigate the scope of the proposed fee increases in this rule for individual applicants and petitioners

It is important to note that these fee changes have not yet gone into effect. USCIS is collecting comments on the proposed rule until March 6, 2023 and the final rule (with implemented fee changes) cannot go into effect until USCIS has received and reviewed public comments. ISSS staff are planning to submit a comment in response to the proposed fee change. USCIS has also prepared this FAQ page.

If you are eligible for and intending to file any of the application forms listed above in the coming weeks, you might wish to apply before or shortly after the comment period closes, if possible, to avoid the increased fees.

2. USCIS Announces Continued Expansion of Premium Processing Service

USCIS recently announced implementation of the final phase of premium processing expansion for the Form I-140, which is used in the employment-based permanent residency (green card) process. Beginning January 30, USCIS will accept premium processing applications for all pending and initial petitions filed in the EB-2 National Interest Waiver (NIW) category.

Future expansion of premium processing services is expected, including certain F-1 OPT and F-1 STEM OPT applications for employment authorization (Form I-765). USCIS will announce specific dates for these changes in February. Also expected is an expansion of premium processing for requests for a change of status (Form I-539) for certain student and exchange visitors in May/June.
